These Terms of Use regulate the access and use of the mobile applications for smartphones that, under the Arroka Berri seal, will be available in the App Store and Google Play (hereinafter “the mobile App”) as well as the website hosted under the domain https://arrokaberri.com (hereinafter “Website”) as well as the contents and services that the Website and the Mobile App make available to its users (hereinafter “Users”).

In compliance with Article 10 of Law 34/2002, of July 11, 2002, on Information Society Services and Electronic Commerce, the following identifying data of the owner of the Website are exposed:

Access to or use of the Website and the Mobile App by the User necessarily implies, without reservation, knowledge and acceptance of these Terms of Use. Therefore, it is recommended that the User read them carefully each time he/she wants to access the Website or enter the Mobile App. Hereinafter we will refer to DISTRIBUTIO as technology and DISTRIBUTIOAPP as rights holder and ultimate responsible indistinctly.

USE OF THE WEBSITE AND MOBILE APPS

Users will be entirely responsible for the correct use of the Website and the Mobile Apps subject to current legislation, whether national or international, as well as the principles of good faith, morality, good customs and public order, and with the commitment to diligently observe any additional instructions that may be given to them by DISTRIBUTIOAPP.

Users shall refrain from using the services and contents of the Website for illicit purposes or effects and that are harmful to the rights and interests of third parties, or that in any way may damage, disable, affect or impair the operation of the Website and the Mobile App, its contents and its services. Likewise, it is forbidden to prevent the normal use or enjoyment of the Website and Mobile App by other Users.

Our antivirus system has a high and standard security level for the type of applications and services of this type that are provided in the market. Therefore, DISTRIBUTIOAPP is not responsible for the potential damages or errors that, due to the presence of any virus, may suffer the computer system (hardware or software) of the Users when they access the Website and Mobile App or use it.

RESPONSIBILITY OF DISTRIBUTIOAPP

DISTRIBUTIOAPP will make reasonable means available to the User to ensure that the content and services included on the Website and the Mobile App are accurate and up to date. However, DISTRIBUTIOAPP is not in a position to guarantee this circumstance at all times. Likewise, DISTRIBUTIOAPP will not be responsible for the operation of the communication networks that enable the operation of the Website and mobile App, whether fixed or mobile, whose responsibility lies entirely with providers outside DISTRIBUTIOAPP.

If deemed appropriate, DISTRIBUTIOAPP may immediately suspend the provision of service and, where appropriate, remove content that it deems incorrect or illegal, either at its sole discretion, or at the request of third parties affected or competent authority, without such suspension may give rise to any compensation.

INTELLECTUAL AND INDUSTRIAL PROPERTY

DISTRIBUTIOAPP is the owner or licensee of all intellectual and industrial property rights included in the DISTRIBUTIO Website and Mobile App, as well as the contents accessible through them.

The intellectual property rights of the Website and Mobile App, as well as the texts, images, graphic design, navigation structure, information and content contained therein are owned by DISTRIBUTIOAPP, who has the exclusive rights to exploit them in any form and, in particular, the rights of reproduction, distribution, public communication and transformation, in accordance with Spanish legislation on intellectual and industrial property rights.

The authorization to the User to access the Website and Mobile App does not imply any waiver, transfer, license or total or partial transfer of intellectual or industrial property rights by DISTRIBUTIOAPP, so its use is strictly prohibited.

MODIFICATIONS TO THE TERMS OF USE

DISTRIBUTIOAPP reserves the right to modify these Terms of Use in accordance with the applicable legislation at all times, which will be duly informed on the Website and Mobile App, so it recommends the User to review them periodically to be informed of how DISTRIBUTIO protects your information.

APPLICABLE LAW AND JURISDICTION

These Terms of Use are subject to Spanish law.

For the resolution of any conflict that may arise from accessing the Web Site and Mobile App, the User and DISTRIBUTIOAPP agree to expressly submit to the courts and tribunals of the city of Madrid, renouncing any other general or special jurisdiction that may correspond to them.

GENERAL INFORMATION

DISTRIBUTIOAPP SOCIEDAD LIMITADA, a company domiciled in Oviedo, Calle Quintana 32, Vivero de Empresas de la Cámara de Comercio, 33009 and with C.I.F. B-74465030 is the owner of the web site located at the domain name http://www.distributio.es (the “Website”) and responsible for the creation of the mobile applications for smartphones called DISTRIBUTIO available on Google Play and App Store (the “Mobile Apps”).

This Privacy Policy applies both to the Website, meaning all pages and subpages included in it, and to the Mobile App. DISTRIBUTIOAPP declines any responsibility for the different privacy and personal data protection policies that may be contained in the web pages that may be accessed through the hyperlinks located on the Website and in the Mobile Apps and not directly managed by DISTRIBUTIOAPP.

This policy has been configured in strict compliance with current legislation on the protection of personal data, that is, among others, the Organic Law 15/1999, of December 13, 1999, on the Protection of Personal Data (the “LOPD”) and the Royal Decree 1720/2007, of December 21, 2007, which approves the Regulation of development of the LOPD.

COLLECTION OF PERSONAL DATA

In accordance with the provisions of the LOPD and its implementing regulations, DISTRIBUTIOAPP informs users that the data provided when registering by filling out the registration form through the Website or Mobile Apps (the “Registration Form”) will be incorporated into an automated file duly registered with the Spanish Data Protection Agency for which DISTRIBUTIOAPP is responsible.

The completion of the Registration Form by users necessarily implies, without reservation, knowledge and acceptance of this Privacy Policy, for which they must validate the box provided for this purpose in the Registration Form. Therefore, it is recommended that the user reads it carefully when completing the Registration Form.

The personal data provided by users will be processed for the purpose of managing relationships with other users of the Website and Mobile Apps. Personal data collected through the Website or the Mobile Apps will not be transferred to any third party, except in specific cases in which such transfer is covered by the LOPD and can only be accessed by DISTRIBUTIO staff as well as by those third parties that provide services to DISTRIBUTIOAPP related to the above purposes.

Users must notify DISTRIBUTIOAPP any changes that occur in the data provided, responding in any case of the truthfulness and accuracy of the data provided at all times. DISTRIBUTIOAPP will try to diligently check the veracity of such data, reserving, where appropriate and without prejudice to other actions that may correspond to it, the right not to register or deregister those users who provide false or incomplete data. This prior verification does not imply in any case the assumption by DISTRIBUTIOAPP of any liability for damages that may arise from the falsity or inaccuracy of the data provided, for which only the user will be liable.

If you upload images to the website, you should avoid uploading images with embedded location data (EXIF GPS) included. Visitors to the website can download and extract any location data from images on the website.

If you edit or publish an article, an additional cookie will be saved in your browser. This cookie includes no personal data and simply indicates the post ID of the article you just edited. It expires after 1 day.
